1. Introduction

Welcome to Tappora, a platform that helps creators and small sellers build personalized landing pages with unique username-based links. These Terms of Service ("Terms") govern your access to and use of Tappora and its related services (collectively, the "Service"). Tappora is owned and operated by Xirosys Cloud Pvt Ltd ("Xirosys", "we", "us", or "our"), a company registered in India.

By accessing or using Tappora, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. We recommend that you read these Terms carefully before using Tappora.

2. Eligibility

You must be at least 13 years old to use Tappora. By using Tappora, you represent and warrant that you are at least 13 years of age. If you are under 18 years of age, you represent that you have your parent or guardian's permission to use the Service and that they have read and agree to these Terms on your behalf.

You are responsible for ensuring that your use of Tappora complies with all laws, rules, and regulations applicable to you and in your jurisdiction. If your use of Tappora would be prohibited by applicable law, you are not authorized to access or use the Service.

3. User Accounts

To use certain features of Tappora, you may need to create an account. When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You agree to:

• Provide accurate information when registering and keep your information up-to-date
• Maintain the confidentiality of your password and account
• Notify us immediately if you discover or suspect any security breaches related to your account
• Accept responsibility for all activities that occur under your account

You may not share your account credentials with any third party. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or no longer current.

4. Use of the Service

You may use Tappora only for lawful purposes and in accordance with these Terms. You agree not to use Tappora:

• In any way that violates any applicable law or regulation
• To engage in hate speech, harassment, or any conduct that is offensive, harmful, or inappropriate
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To transmit any material that contains software viruses or any other computer code designed to disrupt, damage, or limit the functioning of any computer software, hardware, or telecommunications equipment
• To impersonate or attempt to impersonate Tappora, a Tappora employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of Tappora

We reserve the right to terminate or restrict your access to Tappora for any violation of these Terms or for any other reason at our sole discretion.

5. Products and Sales

Tappora allows users to showcase and sell products or services on their personalized landing pages. However, Tappora does not handle payments directly. All transactions are processed through third-party payment processors, and Tappora is not responsible for the processing of these payments.

If you are a seller on Tappora, you are solely responsible for:

• The products or services you list for sale
• The accuracy of your product descriptions and pricing
• Fulfilling orders and providing customer service
• Complying with all applicable laws and regulations regarding your sales, including tax laws

Tappora is not liable for any disputes that may arise between sellers and buyers. Any issues related to products, services, or transactions should be resolved directly between the involved parties.

6. Payment and Subscriptions

Certain features of Tappora may require a paid subscription. If you choose to purchase a subscription, you agree to pay all fees and charges associated with your account on a timely basis and in the currency stated at the time of purchase.

We reserve the right to change our pricing at any time. If we change our prices, we will provide notice of the change on the website or by email at least 30 days before the change takes effect. Your continued use of Tappora after the price change becomes effective constitutes your agreement to pay the changed amount.

All subscription fees are non-refundable except as expressly stated in these Terms or as required by applicable law. Subscriptions will automatically renew for the same subscription period unless cancelled before the renewal date.

7. Intellectual Property

Tappora and its original content, features, and functionality are owned by Xirosys Cloud Pvt Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain ownership of all content you upload, post, or display on or through Tappora. By posting content, you grant Tappora a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any existing or future media in order to provide, promote, and improve the Service. This license is necessary for us to display your content on Tappora and to make it available to others as directed by you through the Service's features.

You represent and warrant that you own or have the necessary rights to the content you post on Tappora and that your content does not infringe or violate the rights of any third party.

8. Termination

We may suspend or terminate your access to Tappora, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use Tappora will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Limitation of Liability

In no event shall Tappora, Xirosys Cloud Pvt Ltd, or its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Tappora is not responsible for any third-party products or services that you may use in connection with the Service, including payment processors, hosting providers, or other service providers. Your use of these third-party services is at your own risk and subject to their respective terms and policies.

10. Changes to the Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any changes by updating the "Last Updated" date at the top of these Terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you an email notification).

Your continued use of Tappora after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, you should stop using the Service and delete your account.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Any disputes arising out of or relating to these Terms or your use of Tappora shall be resolved exclusively in the courts located in Delhi, India, and you consent to the personal jurisdiction of such courts.
